Car Accident AttorneysTwo women who were killed in a San Diego car accident the night of October 31, 2011 were identified as 56-year-old Thoy Insixiengmay and 59-year-old Tem Thirakul. According to a news report in The San Diego Union-Tribune, the fatal car accident occurred in the southbound lanes of the Interstate 805, when the Honda Civic in which the women were passengers, was broadsided by a truck. Officials say, the driver of the Honda, a 35-year-old woman, lost control of the vehicle just after entering the freeway from the Clairemont Mesa Boulevard on-ramp. The car then entered into the path of a FedEx big rig, whose driver was unable to avoid the collision. The truck hit the car on its passenger side forcing it off the roadway. Both, Insixiengmay, who was in the front seat, as well as Thirakul, who was in the back seat, died at the scene. All three occupants of the Civic were wearing their seatbelts.

My deepest condolences go out to the family and friends of Thoy Insixiengmay and Tem Thirakul who were killed in this car versus truck accident. Please keep the victims and their families in your thoughts and prayers.

San Diego Car Accident Statistics

According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), 76 people were killed and 2,268 were injured in car accidents in the unincorporated areas of San Diego County. Countywide, 217 fatalities and 12,998 injuries were reported involving car accidents, during that same year.

What Caused This Fatal Truck Accident?

Based on this news report, it appears that the driver of the Civic lost control and crashed into the big rig. There are many unanswered questions here. Did alcohol, drugs, speed, distracted driving or fatigued driving play a part in the crash? What caused the Civic to lose control? Were any other vehicles involved? Was there an auto defect or mechanical malfunction in the Civic that caused the driver to lose control? I trust officials are looking into these and other issues in order to determine precisely what occurred here and why.

Liability Issues

In this particular case, if the driver of the Civic is determined to have been at fault, she can be held liable for the victims’ wrongful death. In cases where negligence or wrongdoing is involved, families of deceased victims can seek compensation to cover medical expenses, funeral costs, lost future income, loss of love and companionship, and other related damages. An experienced San Diego personal injury lawyer will advise victims’ families in such cases about their legal rights and options.

Even if drugs/alcohol were not contributing factors liability remains with the driver and her estate in most instances.
