Drug Maker Fosamax Accused of Manufacturing Defective Drug

A number of Fosamax Side Effects Lawyers have observed an increase in Fosamax drug claims. More than 900 cases have been filed or are pending against osteoporosis drug manufacturer, according to a news report in TheStreet. The claims that have been piling up against the osteoporosis drug are partly due to an alleged side effect called osteonecrosis of the jaw (ONJ). In the second federal case, Maley V. Merck, the jury gave a unanimous verdict in favor of the drug maker Merck. The jury rejected the plaintiff’s claim who blamed her dental and jaw-related problems to the drug Fosamax.
During the trial, Merck had presented evidence that the company acted appropriately in researching and developing Fosamax. They also gave evidence that they acted appropriately in monitoring the drug after it was released on the market.
Merck’s outside counsel, Christy Jones of Butler, Snow, O’Mara, Stevens & Cannada PLLC, said: “We believe the company acted properly. Unfortunately, the plaintiff had multiple medical conditions that cause people to develop the jaw and dental problems she claims she has, regardless of whether they were taking Fosamax.”
This is indeed a distressing story for Maley who is only one of more than 900 cases against the drug Fosamax. My thoughts and prayers go out to Maley and all victims who suffer from ONJ.
