A car accident in San Diego resulted in fatal injuries for a pedestrian the morning of May 24, 2011. The San Diego Union-Tribune reports that the fatal pedestrian accident occurred on Clairemont Mesa Boulevard near Convoy Street in Kearny Mesa when a Toyota Scion driven by 28-year-old Sean Alvarez struck a 71-year-old man who was crossing the street at the intersection. Alvarez has been booked on suspicion of felony DUI and gross vehicular manslaughter. An investigation is ongoing.

I offer my deepest sympathies to everyone who knew and loved this deceased pedestrian accident victim. They will be in my prayers.

DUI Collisions in San Diego

Laws and Liability Issues

Based on this news report, the pedestrian appears to have been walking in a crosswalk when he was hit. Under California Vehicle Code Section 21950, motorists are required to yield right of way to pedestrians walking in marked or unmarked crosswalks. In addition, officials say Alvarez was driving under the influence. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.” A driver whose act of driving under the influence results in the death of another will likely face vehicular manslaughter charges under California Penal Code section 191.5 (a).

If Alvarez is determined to have been at fault, he could not only face criminal prosecution, but can also be held financially responsible for the elderly pedestrian’s wrongful death. A reputed San Diego personal injury lawyer will be able to advise victims’ families in such cases about their legal rights and options. A knowledgeable car accident attorney will also advise them about how their own car insurance policy might apply to an incident where the at-fault driver is uninsured or underinsured.
