Fatal Los Angeles Car Accident

Jerry Ruiz, 33, was killed in a Los Angeles car accident that involved a rear-end collision. According to a news report in the San Gabriel Valley Tribune, the fatal car accident occurred the morning of January 29, 2011 on the eastbound 210 Freeway near Buena Vista Street in Duarte. Ruiz drove his 2003 Mercedes-Benz SLK 500 into the back of a GMC utility truck. Police believe Ruiz may have been travelling 95 miles per hour before the accident. Ruiz died at the scene of the accident and the 66-year-old Sierra Madre man driving the GMC suffered injuries, which were not life-threatening. The cause of this car accident is under investigation.

My deepest condolences go out to the family and friends of Jerry Ruiz. My thoughts and prayers are also with the Sierra Madre man injured in this car accident.

Car Accident Statistics

According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 70 people were injured in Duarte car accidents. During that same year, there were 667 fatalities and 52,229 injuries reported as a result of Los Angeles County car accidents.

What Caused This Fatal Car Accident?

Police are still investigating the cause of this tragic car accident. According to the report, Ruiz was traveling at a high rate of speed. California Vehicle Code Section 22350 (Basic Speed Law) states: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

Also, according to California Vehicle Code Section 21703: “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.”

Liability Issues

In such cases, it is important to look into whether vehicle defects or mechanical malfunctions played a part. If Ruiz is determined to have been at fault, the other injured victim can seek compensation from his estate or liability insurance. If an auto defect led to this accident, then the Ruiz family could file an auto products liability claim against the auto maker. It would also be a good idea, in these types of accidents, to preserve the vehicle in its current, damaged condition so it can be thoroughly examined by an expert for auto product defects including design flaws, mechanical problems and other evidence. An experienced Los Angeles personal injury lawyer will be able to better advise car accident victims or their families about their legal rights and options.

Was the driver under the influence at the time? Was speed a factor in this fatal car accident? Was there a dangerous condition on the roadway? Were other vehicles involved? Was driver distraction a factor? Was there a vehicle defect or mechanical malfunction that may have caused or contributed to the car accident? I trust officials are looking into these and other issues in order to determine what exactly occurred here.
