Lawsuit Filed Against the City of Azusa by California Personal Injury Lawyers

The personal injury lawyers of BISNAR | CHASE (www.BestAttorney.com) have filed a lawsuit against City of Azusa, Azusa Pacific University and a trolley operator who ran the trolley on campus. The suit stems from many accidents that have taken place on the road, and an incident of motor vehicle negligence where a student at Azusa Pacific University, Julie Farris, was struck by the trolley in an area of dangerous conditions of public property and sustained severe brain injury.
According to court documents, on February 19, 2008 Julie Farris was riding her bicycle on the West Campus of Azusa Pacific University when she was struck by the school-run trolley. The trolley was operated by a university employee, Oscar Armando Galan, and the impact caused Julie to suffer catastrophic personal injuries.
“We allege Julie suffered severe permanent injuries at the hands of both the City of Azusa and Azusa Pacific University, both of which knew the roadway on which Julie was traveling was unsafe for students.” said Brian Chase, a partner at the Los Angeles personal injury law firm, BISNAR | CHASE. “What’s equally disturbing is the fact that both the City and the University knew there had been numerous accidents on the roadway and that the majority of university students were riding against traffic, yet did nothing to warn students or the public about these dangers, and did nothing to fix the roadway.”
Azusa’s Roadways are Dangerous
The road bicyclists and pedestrians must travel between Azusa Pacific University’s East and West campuses is a narrow, congested roadway that is owned and maintained by the City of Azusa. Students travel this road often, and are forced to ride against traffic next to numerous parked cars due to the lack of bike paths, crosswalks and traffic signals. The lack of necessary safety structures on the narrow road make this an unfit roadway for students to be traveling daily.
The suit alleges that the City of Azusa has failed in its duty to provide a safe environment for its students, especially since the scheduling of classes forces students to travel the unsafe road during peak traffic hours when traffic congestion is at its worst.
Azusa Fails to Fix Dangerous Road Conditions
“We allege that not only did Azusa Pacific University use funds earmarked for roadway improvements for other unrelated projects, it failed to warn people about the dangers of this roadway which further demonstrates its negligent and reckless disregard for human safety,” said Chase.
After many dangerous and fatal car accidents have taken place on the road, Azusa still failed to improve the conditions of the roadway. According to the lawsuit, they instead used the funds allotted to road improvements for other projects, at the expense of the public.
The action, brought against the defendants by Julie Farris, seeks economic damages for severe personal injuries, pain and suffering and permanency, past and future hospital, medical and other healthcare expenses, and loss of past and future wages and earning capacity.
The case is currently pending in the Superior Court of California, County of Los Angeles, case #KC055075.
